thanks a lot for joining us. i'm jon kelley. >> i'm marla tellez. we begin with a warning for visitors to a popular palo alto trail. police are on the lookout for a man who tacked and groped a female jogger. she was assaulted running along the palo alto baylands nature preserve close to the golf course. kristi smith with new information from a detective on this case. kristi, good morning. >> reporter: good morning. that's right. palo alto police are suggesting women partner up when they come out to these trails to exercise. as you can see, they get excluded around the turns out here. this is where a woman was attacked.

fortunately she escaped this attempted sexual assault. right now detectives are working with her on a sketch. the jogger tried to let a man pass three times, because he was making her uncomfortable following from behind on a popular palo alto trail. but he still jumped her from behind. now, word of the attack is spreading fast. >> i am very surprised, because this area is used by walkers, joggers, myself, and cyclists, like we start our cycling routine here. >> reporter: it was two cyclists that happened to ride up at the baylands nature preserve late sunday morning. the woman was fighting him off after he sexually groped her. they stopped to her her as the attacker ran away. >> we're going to be stepping up our patrols out there. we've let our partnering cities know. east palo alto is on the other side of the bridge where the suspect apparently fled. >> reporter: park rangers are on alert. police want to speak to the

cyclists because they are witnesses. another woman came forward saying 45 minutes earlier a similar manifold her from a bathroom off a trailhead where joggers often start. >> did you change anything up? >> no. >> not going to change anything up? >> like i said, if i get a little nervous, i'll go a different route. >> we've always felt safe. i come by myself all the time. i'm really shocked to hear about it. it makes me nervous. >> reporter: the attacker is described as a hispanic male, possibly biracial, 20 years old, 5'8" tall, 160 pounds, dark buzzed hair, cleanshaven with diamond studs in his ears, both the ears. they say he was wearing blue shorts, white t-shirt and white tennis shoes. police say they don't think this is related to any other assault recently in different parts of palo alto. they are expecting to release that sketch sometime later this afternoon. reporting live in palo alto,

christie smith, nbc by area news. >> christie smith, thank you nor the update. san jose made arrests in the slaying deaths of two teenagers. the suspects are teens themselves. one is matthew clifford of san jose. a 17-year-old was also arrested. his name at this point has not been released. the san jose police covert response and metro units tracked down those suspects on saturday. the teenagers stand accused and are suspected of shooting and killing 15-year-old christian comilang and 16-year-old johnson cular in east san jose two sundays ago. police at this point do not believe the double shooting was gang related. delivered has been booked into the santa clara county jail. the second suspect is at juvenile hall. >> from the south bay to east bay, one person is dead and another in the hospital in a shooting that ended in a crash in oakland. police found a car crashed into a pole on gormley avenue near

98th street and 880. both people in the car had been shot. one of the victims had already died by the time officers arrived. the second victim was rushed to the hospital and at last check is in stable condition. police have not released information on possible suspects. it was a major mistake in the classroom. this one could cost a bay area high school teacher his job. police say he accidentally showed his class a naked picture of himself. after 16 years working the district richard steiner at san leandro high is facing serious charges. steiner came under serious scrutiny last april when he reportedly told a staff member at the school he accidentally showed his class that naked picture during a file sharing demo. school officials then called police. during a search of his school computer, investigators found child pornography and over 200 pornographic stories. steiner right now is on unpaid administrative leave. some of the parents there, they were upset they were not

notified. >> even though the class -- the school has taken the lead here and notified authorities, i think that perhaps maybe notification should have come out to the parents as well. >> the district attorney's office posting a statement on its website say it is deeply concerned. meantime, steiner's attorney says, quote, no one should jump to any conclusions or form any opinion at this point as to whether rick styner has committed a crime. in fact, from when i've seen so far, there is not sufficient evidence to convict mr. styner of any crime. he's expected to answer the child poor graph charge sometime next week in court. just into the newsroom, a judge accepted james holmes plea of not guilty by reason of insanity in the colorado theater shooting. holmes will now be given a court ordered psychiatric evaluation. that could last for months. holmes is charged with 166 counts of murder and attempted

murder for the shooting at an aurora moving theater last summer. oscar pistorius showing up at the court ahead of his murder trial. the double amputee olympian accused of murdering his girlfriend back on valentine's day. pistorius denied the murder charge saying this was a case of mistaken identity. more from pretoria south africa. >> reporter: oscar pistorius looks composed as he arrives here at the court in pretoria this morning. he barely spoke a word during the 20-minute hearing, which was a big step towards his murder trial which may come early next year. he's accused of the premedicated murder of his girlfriend reeva steenkamp on the morning of valentine's day. he says that he shot through the bathroom door where reeva steenkamp was sitting because he thought an intruder broke into his home. he was told inside court he must return here on august 19th or

face having a warrant for his arrest issued. that is the same day that would have been reeva's 30th birthday. nbc news, pretoria. it was an early wakeup call for people living in a san francisco neighborhood as an suv slammed into a home. take a look at this. this gold range rover crashed into this home in the city's bay view district. you can see the suv partially into the garage from the video taken from our chopper mpl the female driver was taken to the hospital with minor injuries. it was nothing short of a very rough ride this morning with a rock slide causing a crash on highway 101. this one happened a little after 2:00 in sausalito. chp officers on scene telling us at one point three of the four southbound lanes on 101 were blocked. we had a chance to talk to one driver who actually hit the rocks driving home from work.

>> the rock slide. it was so dark. a big rock and kind of hard to climb over, the airbag. >> man, that had to be scary out there. she also said the road was very dark in the area and they really couldn't see the rocks. we're happy to report no one was seriously hurt. caltrans cleared that road about an hour after the rock slide. a new sickness linked to frozen berries sold at costco. health officials estimate about 30 californians got sick with hepatitis a after eating these berries sold under the name townsend farms organic antioxidant blend. we told you yesterday about a woman from contra costa county being one of those affected. now we're learning a man from alameda county also got sick from the berries. both of them have been treated at the hospital and have since been released. meanwhile a southern california woman is already taking legal action. she's suing costco and also the

makers of the berries. she's still in the hospital and she's isolated from other patients but she is expected to recover. >> it was the last thing i could have imagined was making me sick. they were asking me if i had recently been in a third world country or if i've ever used needles or anything like that. >> if you do have these berries, health officials say you should absolutely throw them away. >> there's some progress and positive news for firefighters down in northern l.a. county finally able to get a better handle on a massive wildfire. those cooler temperatures and light winds overnight helping them get the so-called powerhouse fire now 60% contained. so far we can tell you it's destroyed at least six homes and burned through about 50 square miles. give you a reference, that's roughly the size of the entire city of san francisco. all mandatory evacuation orders have now been lifted. the cause of this fire still remains under investigation. voters are heading to the

poles today in several bay area counties for local elections. in santa clara county voters will make a key decision on who the replace a disgraced county supervisor. nbc bay area's bob redell has more from the registrar of voters in san jose. >> reporter: today's special election here in the south bay is one that few voters seem to care about. the santa clara county registrar of voters estimates the turnout to be only 35 to 45%. that's the expectation. it's not cheap to put one of these things on, expected to cost at least a half million dollars. voters will be electing a new santa clara county supervisor for district two which encompasses most of downtown san jose and areas immediately east and south. seven candidates in the running but only five have been attending the debate including this one put on by the tv community channel. the first and second place could compete in a runoff. one political analyst does

expect that to be happening. candidates are vying for a ppgs position vacated by george shirakawa. earlier this year he pled guilty to five felonies and seven merchandise for abuse of public funds. he incidentally will be sentenced for those crimes this friday. here in san jose, bob redell, nbc bay area news. thank you, bob. it's also election day in several other bay area counties, in contra costa county hercules residents will vote on measure a which will rays taxes on utilities to bring in more revenue for the city. the bolinas stinson school district voting on a pars sell tax to fund school programs. a ballot watsonville will allow the city to an ex farmland for newer developments. a family hoping to find a stolen lawn ornament with strong sentimental value. a pink pig riding a bicycle with rainbow colored wheels. this disappeared from the family's home off newark boulevard on tuesday. the family says the art is very special, because it was a gift to their 7-year-old daughter

the los gatos town council has given go ahead for a

controversial business park in hopes of keeping netflix from skipping town albright on winchester boulevard and albright way. the council did cut down the size of the project limiting the square footage and height of the proposed buildings from the developers original plan. netflix is growing and says it needs to move to a bigger building of the company has already signed a ten-year lease for one of the new buildings. okay. here is a question. who is your worst critic when you're driving a car? a brand-new study says spouse or significant other. that's what your main squeeze is for. insurance.com surveys 500 drivers age 18 or older. the number one gripe from back seat drivers, speed. the number two issue, differing opinions on routes and directions. of course it is. the least critical passengers appear to be teenager sons and daughters. they are busy playing video games in the back. >> they like to speed, the need for speed. lululemon bringing back those yoga pants to store shelves with a new design. you might remember the company

recalled some of its pants back in march because the fabric was just too sheer. >> i remember that, too. >> lululemon said it revamped its design and new pants available in some stores and also online. among the changes the new pants have more fabric across the back side so they won't be see-through any longer. >> that's good news to hear. all right. finally. >> big news coming out of the white house this morning. >> forget all those headlines of controversy. the president now taking on trolls. scott mcgrew, these trolls are real? >> yes, good morning. patent trolls, people or companies who buy up patents with the sole intention of using toss dubious patents to sue big successful companies. the president has issued a series of executive orders this morning, sent several recommendations to congress as well. it's really the first patent reform in decades. patent suits are a huge problem here in silicon valley. john a jon and marla if you and i came

up with a clever idea, start add company, it's almost guaranteed we'd be hit with some shaky patent suit. we'd probably win in court but the problem is we can't afford to go to court because we're a startup, so we settled. that just encourages toss trolls. at least we can get swiper to stop swiping. dora the explorer returning to the internet. viacom signed a deal with amazon to stream dora on amazon on demand. netflix lost the rights to do so recently. san francisco-based sales force will buy exact target. they are a company out of indianapolis. for $2.5 billion. what sales force and target do are not exactly sexy, but they provide software services over the internet for business people. not that interesting, really, but you can tell by that price it's a big, important industry, very important to us here in the bay area. back to you. >> thank you, scott. here is something that might whet your appetite this morning or not.

look here, san francisco two things to point out. can you see old glory finally getting a pick up. the breeze is picking up. that's going to clear out the cloud cover. that additional cloud cover this morning, going to keep temperatures down cooler than where we ended up yesterday. look at the difference, clouds are stubborn, just won't clear, santa rosa at 58. sunnyvale living up to their name, 74, lots of sunshine in the south bay. cool ocean air inland throughout the day today. that means you can open up the windows in your home, let that cool breeze in. you can probably give your ac a break. you're going to need it very soon. wait until i show you that seven-day outlook. clouds hug the coastline and cool ocean air will be transported all the way inland. in fact, even further than yesterday. some creep through the delta. it's going to be a nice day. then high pressure moves in quickly. this area is packing a lot of energy, so it's going to bring our temperatures way up very quickly in addition to generating dry offshore breezy, hundreds inland, 70s and 80s

jason kidd calling it a career. the graduate in alameda says he will not be playing another season in the nba. the 40-year-old played a total of 19 seasons as a pro, winning a world championship with the dallas mavericks back in 2011. he also took home a pair of olympic gold medals with team usa. >> 49ers head coach jim harbaugh said he loves a no nonsense honesty of judge judy. recently he got to see her in action. he and his father jack went to a taping of the show. from the looks of it, both father and son -- >> riveted. >> enjoyed themselves. it's a fun fact judge judy makes about $45 million a year compared to jim harbaugh's $5 million. talk about dedication, the brand-new punter turned down a date with the president.

he's a vocal advocate of gay marriage. he was invited to the white house in honor of lesbian, gay, transgender month. it was the last day of the mandatory three-day mini camp. in a letter he wrote, unfortunately, not even the president of the united states is allowed to supersede an nfl mandatory mini camp practice. as a current member of the oakland raiders, i owe it to both my teammates and my coaches to be fully prepared for the upcoming season. i like that team attitude. >> yeah, but no exceptions, huh? >> mandatory. they write your paychecks. >> that's true. we all know that he can spell it, but can he eat his words like a champion? >> we shall find out, the spelling bee winner gets a crack at a knaidel.

the national spelling bee champion tried a knaidel for the very first time. >> he won the scripps spelling bee last week after correctly spelling knaidel. a yiddish term of german origin, a dumpling or leavened dough cooked by boiling water. you see it here. it's more commonly known as a matzah ball. >> he's blowing on it, smart. >> he had never eaten one. he said he liked it. >> you could tell he liked it. >> here is a tid bid. he's a vegetarian so they had to modify the recipe which called for beef broth. they had to add him to the wall of fame. >> kids, it pays off. study, learn to spell and you'll be eating mashed up wads of dough. >> have a great day, everybody.
